These Terms of Use ("Terms") govern your access to and use of the HTS classification service (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Nature of the Service
The Service provides AI-assisted HTS (Harmonized Tariff Schedule of the United States) classification support for apparel products based on information supplied by the user.
The Service:
- Generates suggested 10-digit US HTS classifications
- Provides explanations and confidence indicators to support classification decisions
- Is intended solely as a decision-support tool
The Service does not provide legal advice, customs brokerage services, or binding tariff classifications.
2. No Guarantee of Accuracy or Acceptance
HTS classification is inherently complex and fact-specific. While the Service is designed to assist with classification analysis, no guarantee is made that any HTS code generated is accurate, complete, or will be accepted by U.S. Customs and Border Protection (CBP) or any other authority.
Classification outcomes may vary based on additional facts not provided, changes in HTSUS provisions, CBP rulings, or enforcement practices.
3. User Responsibility
You acknowledge and agree that:
- You are solely responsible for the accuracy and completeness of all information you provide
- You are responsible for independently reviewing and validating any HTS classification before use
- The Importer of Record retains full legal responsibility for tariff classification, duty payment, and customs compliance
- Use of the Service does not transfer or reduce any statutory or regulatory obligations
4. No Customs Broker or Attorney Relationship
Use of the Service does not create a customs broker-client, attorney-client, fiduciary, or advisory relationship. The Service operates as an automated analytical tool and does not act as a licensed customs broker or legal advisor.
5. Use Limitations
You agree not to:
- Represent Service outputs as CBP-approved or legally binding
- Rely solely on the Service for high-risk, disputed, or litigated classifications
- Use the Service in a manner that violates applicable laws or regulations
- Input false, misleading, or incomplete product information
6. Assumptions and Confidence Indicators
The Service may:
- Make explicit assumptions where information is missing or ambiguous
- Provide confidence scores or indicators to reflect uncertainty
These indicators are informational only and do not alter the user's responsibility to review and confirm classifications.
7. Limitation of Liability
To the maximum extent permitted by law:
- The Service provider shall not be liable for any indirect, incidental, consequential, or punitive damages
- The Service provider shall not be liable for duties, penalties, fines, delays, seizures, or enforcement actions arising from the use of Service outputs
- Total liability, if any, shall not exceed the fees paid for use of the Service during the preceding twelve (12) months
8. Changes to the Service or Terms
The Service and these Terms may be modified, updated, or discontinued at any time without prior notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict-of-law principles.
